We believe these statements may constitute misrepresentations in potential violation of 18 U.S.C. § 1001 (False Statements to Federal Agencies) and 37 C.F.R. § 11.18(b) (Duty of Candor in USPTO Proceedings).
After serving HOA communities since 2024, ThePerfectHOA.com is transitioning to a new brand. Here's the story of what happened and why we're making this change.
ThePerfectHOA.com was a homegrown solution, born out of love for our own HOA community. We are a family-run business built on the foundation of high morals, honesty, integrity, and transparency. We believe in earning trust through hard work. We believe in building relationships. We believe that success should come from serving our customers well.

The timeline of events that led to this decision
ThePerfectHOATM was born in 2024. Then in 2025, a company with a nearly identical name appeared and claimed they were there first. We have documented, verifiable evidence — domain registrations, payment records, corporate filings, and web archives — that we believe tells a different story.
Our company (a Georgia corporation since January 2019) registered ThePerfectHOA.com and began offering HOA management software services to communities.
We had established a customer base with paying HOA clients using our SaaS platform for violation management, ACC applications, and community communications.
A company called Perfect HOA, Inc. (Robert DuBois) launched PerfectHOA.com — nearly a year after we were already operating.
PerfectHOA, Inc. filed for a "PERFECT HOA" trademark with the USPTO, including a Petition to Make Special containing statements about launch dates and our business status that we dispute. The petition explicitly noted: "EVIDENCE FILE NAME(S): No evidence attached."
The USPTO found the petition was incomplete for lack of "supporting evidence" and required proof of alleged infringement.
PerfectHOA, Inc. submitted a response with "customer confusion" screenshots — images with no timestamps or verifiable metadata that we believe do not constitute reliable evidence.
After the supplemental submission, the USPTO granted the petition. We believe the statements in that submission were material to the decision.

"The owner of theperfecthoa.com mistakenly went to our website and filled out our contact form... I traced the phone number to the competing company."

Our Perspective on the Process
The USPTO initially rejected PerfectHOA's Petition to Make Special on July 21, 2025, stating it lacked "supporting evidence." Only after the August 11, 2025 response — which included the screenshots and statements we dispute — did the USPTO grant the petition on August 14, 2025. We believe the statements in that submission were material to the decision.

We are a small business. We filed a Letter of Protest with the USPTO documenting our concerns with clear, verifiable evidence. We believe the evidence supports our position.
We engaged in communication with the examining attorney at the USPTO, but we do not believe our documented evidence was adequately considered.
When undated screenshots without metadata are accepted while official domain registrations, corporate filings, and merchant payment records appear to be overlooked, we question whether the process worked as intended.
So we've made a business decision: Rather than continue this dispute, we're rebranding and moving forward. ThePerfectHOA.com is being retired, but our mission continues — a new brand is launching soon.
